§1 Seller Information

The Seller is the controller of Customers’ personal data.
§2 Definitions
Customer – any natural person, legal entity or organizational unit making a purchase.
Consumer – a natural person making a purchase not directly related to their business or professional activity.
Entrepreneur with Consumer Rights – a natural person concluding a contract directly related to their business activity when the contract does not have a professional character for them.
Product – movable goods (shoes, clothing) available in the Store.
Distance Contract – a contract concluded via the online Store.
§3 Technical Requirements and Use of the Store
To use the Store, the following are required:

a device with Internet access,

an up-to-date web browser,
-
an active e-mail account.
It is prohibited to provide unlawful content.
The Seller may block a Customer’s account in the event of a violation of these Terms and Conditions.
§4 Placing Orders and Conclusion of the Contract
Orders may be placed 24 hours a day.
Placing an order constitutes an offer to conclude a sales contract.
After placing an order, the Customer receives an e-mail confirming receipt of the order. This message does not constitute acceptance of the offer.
The sales contract is concluded upon the Seller sending an e-mail confirming acceptance of the order for processing.
The Seller reserves the right to:

refuse to process an order in case of false or incorrect data,
-
cancel the order if payment is not made within 3 business days (for advance payments),
-
withdraw from processing the order in the event of an obvious pricing error resulting from a technical mistake.
§5 Prices and Payments
All prices displayed in the Store are gross prices (including VAT).
Prices do not include delivery costs, which are indicated before placing the order.
Available payment methods:

online bank transfers,

BLIK,
-
payment card.
In the event of an obvious pricing error caused by a technical issue, the Seller reserves the right to withdraw from the order and will inform the Customer immediately.
§6 Delivery
Delivery is available within Poland / the European Union.
The order processing time is from 1 to 5 business days, unless otherwise stated in the Product description.
In the case of Consumers, the risk of accidental loss or damage to the Product passes to the Customer upon delivery of the Product to the Customer.
The Customer is advised to inspect the shipment upon delivery. In case of damage, it is recommended to prepare a damage report with the carrier.
§7 Right of Withdrawal
Consumers and Entrepreneurs with Consumer Rights have the right to withdraw from the contract within 14 days without providing any reason.
The withdrawal period expires 14 days after the day on which the Customer receives the Product.
To exercise the right of withdrawal, the Customer must inform the Seller by e-mail.
The Customer bears the direct cost of returning the Product.
The Product must be returned within 14 days from the date of withdrawal.
The Customer is liable for any diminished value of the Product resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the Product.
The Seller may withhold reimbursement until the Product is received or proof of its return is provided.
Reimbursement will be made using the same payment method used in the original transaction, unless the Customer expressly agrees otherwise.
§8 Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

Products made to the Customer’s specifications,
-
personalized Products,
-
sealed Products which are not suitable for return due to health or hygiene reasons once unsealed.
§9 Complaints (Lack of Conformity)
The Seller is liable to Consumers for lack of conformity of the Product with the contract in accordance with applicable law.
Complaints should be submitted by e-mail to: info@tivanno.pl.
The Seller will respond to the complaint within 14 days.
If the complaint is accepted, the Seller will:

repair the Product,
-
replace the Product,
-
reduce the price,
-
or issue a refund, in accordance with applicable law.
§10 Liability Towards Business Customers
In relation to Customers who are not Consumers, the Seller’s liability is limited to the value of the order.
To the extent permitted by law, statutory warranty rights are excluded for business Customers.
§11 Personal Data
Personal data is processed for the purpose of order fulfillment and in accordance with the Privacy Policy available on the Store’s website.
§12 Out-of-Court Dispute Resolution
Consumers may use out-of-court dispute resolution methods, including:

mediation,

arbitration,

§13 Final Provisions
Matters not regulated herein shall be governed by Polish law.
Disputes with Consumers shall be resolved by the competent court in accordance with applicable regulations.
Disputes with business Customers shall be resolved by the court having jurisdiction over the Seller’s registered office.
The Seller reserves the right to amend these Terms and Conditions for important legal or organizational reasons. Amendments do not affect rights acquired by Customers prior to the change.
